Welcome to AIPortraitLab. These Terms and Conditions (“Terms”) govern your access to and use of our website, services, and digital products. By accessing our website and submitting an order, you agree to be bound by these Terms in full. If you do not agree with any part of these Terms, you must not use our services.

1. Overview of Services

AI Portrait Lab is a digital service that uses artificial intelligence technology to enhance, generate, or stylize user-submitted images based on customer input and selected packages. All final products are delivered digitally via email. We do not provide physical prints or shipping services. By using our platform, you acknowledge that the results are generated using machine learning algorithms and may vary based on the quality of submitted content and the complexity of the requested enhancements.

2. User Submissions and Content

By submitting any images, notes, or special requests through our order form, you represent and warrant that you either own the intellectual property rights to such content or have obtained express permission from the rights holder to use and modify such content. You agree not to submit any images that are illegal, pornographic, abusive, defamatory, obscene, or infringe on the rights of any third party.

You retain full ownership of your original images. However, by submitting them to AI Portrait Lab, you grant us a non-exclusive, non-transferable, royalty-free license to use the content solely for the purpose of fulfilling your order. Unless otherwise requested at the time of order, we reserve the right to use samples of the final work for promotional purposes, such as our website portfolio or marketing materials. We will not share any personally identifiable information without your consent.

3. Ordering Process and Payment

All orders must be submitted through the official order form on our website. Upon submission, our team will review the details of your request to determine whether we can fulfill the order to our professional standards. If we accept your request, you will receive an email containing payment instructions. Payment is required in full before we begin work on your portraits.

Prices for each package are listed clearly on the site and are subject to change at any time without notice. All payments are processed securely through trusted third-party payment processors. We do not store or have access to your payment credentials.

4. Turnaround Time and Delivery

We aim to deliver your completed portraits within 12 to 48 hours after payment has been received. Actual turnaround times may vary depending on order volume, complexity, and the number of images submitted. Orders are fulfilled in the order they are received.

Delivery is completed via email to the address provided in your order form. It is your responsibility to ensure that the email address is accurate and accessible. AI Portrait Lab is not responsible for missed or delayed deliveries resulting from spam filters, typos, or technical issues beyond our control.

5. Revisions and Limitations

We strive to meet or exceed your expectations with every order. One complimentary revision is included with each package, provided it is requested within three (3) days of delivery. Revisions are limited to minor adjustments such as lighting tweaks, color corrections, or style refinements. Requests that involve new image submissions, major design changes, or extensive alterations may require a new order and additional payment.

As AI-generated content is based on learned algorithms, the results may not always perfectly match subjective expectations. While we work to deliver high-quality results, you acknowledge that artistic output can vary, and perfection is not guaranteed.

6. Refund Policy

Due to the customized and digital nature of our service, all sales are final. Once an order has been processed and work has commenced, we do not offer refunds or cancellations. Exceptions will be considered only if we are unable to deliver the service due to internal issues or unforeseen circumstances. Refunds are issued solely at our discretion.

If you are dissatisfied with the final product, you are encouraged to contact our support team within three (3) days of delivery so we may try to address your concerns.

7. Intellectual Property and Usage Rights

Upon delivery and full payment, you are granted a non-exclusive, perpetual license to use the final portraits for personal purposes including sharing on social media, printing for private use, or gifting. Commercial use of the artwork, such as resale, brand promotion, product merchandising, or inclusion in monetized content, is not permitted without prior written authorization from AI Portrait Lab.

We retain ownership of the AI-generated output until payment has been made in full and reserve the right to store anonymized versions for quality control, internal testing, and portfolio display, unless explicitly requested otherwise at the time of ordering.

8. Privacy and Data Protection

We respect your privacy. All images, personal details, and communication are kept confidential and are used strictly for the purpose of completing and delivering your order. We do not sell, rent, or share your data with third parties outside of our core operations. Files are stored temporarily and deleted within seven (7) days of order completion unless requested otherwise by the client.

9. Limitation of Liability

To the fullest extent permitted by applicable law, AI Portrait Lab and its team shall not be held liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of our services, including but not limited to errors in image output, data loss, delays in delivery, or dissatisfaction with the aesthetic outcome.

Our total liability for any claim shall not exceed the total amount paid by you for the specific order in question.

10. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the province of Ontario, Canada. Any disputes or claims arising under or in connection with these Terms shall be resolved exclusively in the courts of Toronto, Ontario.

11. Amendments

We reserve the right to modify or update these Terms and Conditions at any time. Continued use of our website or services following any such changes constitutes your acceptance of the updated Terms. It is your responsibility to review this page periodically for the latest information.
